Terms of Use

These terms explain what you can expect from ShiftRoot, what we expect from you, and the limits of what the app can do. Please read the safety section in particular.

1. Agreement to these terms

These Terms of Use are a legal agreement between you and TECHOCTO TECHNOLOGIES PRIVATE LIMITED ("ShiftRoot", "we", "us"), a company incorporated in India under CIN U62099HP2026PTC012480 with its registered office at Choras Tarna (133), Nohradhar, Sirmaur – 173104, Himachal Pradesh, India. They cover the ShiftRoot iOS app and shiftroot.app (together, the "Service").

By downloading, signing up for, or using ShiftRoot, you agree to these terms. If you do not agree, please do not use the Service.

Our Privacy Policy and Subscription Terms also form part of this agreement.

2. Who can use ShiftRoot

You must be at least 13 years old to use ShiftRoot. If you are under 16 and live in the UK or EEA, you need permission from a parent or guardian.

You may not use the Service if you are barred from doing so under applicable law, or if we have previously terminated your account.

3. Your account

You are responsible for keeping your login details secure and for everything that happens under your account. Please give us accurate information when you sign up, and tell us promptly if you believe your account has been compromised.

One person, one account. Accounts may not be shared, sold, or transferred.

4. Your licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to use ShiftRoot on Apple devices you own or control, for your own non-commercial use, in accordance with these terms and the App Store Terms of Service.

You may not copy, modify, reverse-engineer, decompile, resell, or create derivative works from the Service, except to the limited extent that applicable law expressly permits despite this restriction.

5. Acceptable use

When using ShiftRoot, you agree not to:

  • Break the law, or use the Service for anything unlawful.
  • Attempt to gain unauthorised access to our systems, other users' accounts, or any data that is not yours.
  • Interfere with, overload, probe, or disrupt the Service or the infrastructure it runs on.
  • Use bots, scripts, emulators, modified clients, or any automated means to interact with the Service.
  • Upload anything malicious, or use a display name or profile picture that is offensive, misleading, or impersonates someone else.
  • Scrape or harvest data about other users, including from the leaderboard.

6. Streaks and fair play

A streak represents a real day in which you genuinely stayed within your limit, slept on time, and completed your wake-up mission. Streaks are a record of days you kept, so integrity matters - to you more than to us.

You agree not to falsify streaks — including by faking motion or step data, having someone else complete your mission, tampering with your device clock or time zone to gain an advantage, running the app on an emulator, or exploiting bugs instead of reporting them.

If we reasonably believe a streak was not honestly earned, we may reset it and — for repeated or deliberate abuse — suspend or close the account. Where practical, we will tell you why and give you a chance to respond.

Using the emergency pass or the honest override is not cheating. Those are legitimate features. They simply cost you your streak, as the app tells you at the time.

7. Important safety information

Do not rely on ShiftRoot as your only alarm for anything critical. Alarms can fail because of a flat battery, a silenced or restarted device, an iOS update, a permission change, or a software fault. Use a second alarm when missing a wake-up would matter.

Physical activity

Wake-up missions involve physical movement, including push-ups and walking. Only attempt what is safe for you. If you have any injury, medical condition, or doubt about exercising, speak to a doctor first and choose a non-physical mission such as maths. Stop immediately if you feel unwell. Make sure your surroundings are safe and clear before you start moving with your phone.

Not medical advice

ShiftRoot is a wellbeing and productivity tool. It is not a medical device, and nothing in it is medical advice, diagnosis, or treatment for sleep disorders, addiction, or any other condition. If you are struggling with sleep or with compulsive technology use, please talk to a qualified professional.

App blocking has limits

Blocking depends on Apple's Screen Time framework and on iOS behaving as expected. It can be bypassed — for example through another device, a web browser, or by changing iOS settings — and it may occasionally fail. ShiftRoot adds friction to help you keep a commitment you have made to yourself; it is not a security control or a parental-control guarantee.

8. Third-party services

ShiftRoot relies on services we do not control, including Apple's App Store, Screen Time framework and push notifications, and the publishers of articles offered in the reading feature. We are not responsible for those services, their availability, or the content of third-party articles, and linking to them is not an endorsement.

9. Intellectual property

The Service, including its software, design, branding, text and graphics, belongs to ShiftRoot or our licensors and is protected by intellectual property law. These terms give you a licence to use the app; they do not transfer any ownership to you.

You keep ownership of the content you provide, such as your display name and profile picture. You grant us a licence to host and display that content as needed to operate the Service, including showing it on the leaderboard.

10. Availability and changes to the Service

We aim to keep ShiftRoot running reliably, but we do not promise it will always be available or error-free. We may change, suspend, or discontinue features, and we may impose limits, at any time. Where a change is significant and adverse, we will give reasonable notice if we can.

11. Suspension and termination

You may stop using ShiftRoot and delete your account at any time from within the app. Deleting your account does not automatically cancel a subscription bought through Apple — see the Subscription Terms for how to cancel.

We may suspend or terminate your access if you breach these terms, if we are required to by law, or if we reasonably believe it is necessary to protect the Service or other users. Except where a serious breach makes it inappropriate, we will give you notice.

12. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or that it will produce any particular result, including any improvement in your screen time, sleep or wakefulness.

Some jurisdictions do not allow certain warranties to be excluded, so parts of this section may not apply to you. Nothing here limits your statutory rights as a consumer.

13. Limitation of liability

To the fullest extent permitted by law, ShiftRoot will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or opportunity, arising out of or relating to your use of the Service — including any missed wake-up, missed appointment, or lost streak.

Our total liability for all claims relating to the Service in any twelve-month period is limited to the greater of the amount you paid us in that period, or USD 100.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

14. Indemnity

You agree to indemnify and hold ShiftRoot harmless from claims, damages and reasonable costs arising from your misuse of the Service, your breach of these terms, or your violation of the rights of anyone else. This does not apply to the extent the claim arises from our own breach or negligence.

15. Apple-specific terms

These terms are between you and ShiftRoot, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide any maintenance or support for ShiftRoot. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.

Apple is not responsible for addressing any claim relating to the app, including product liability, regulatory compliance, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You confirm that you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government restricted-parties list.

16. Changes to these terms

We may update these terms from time to time. If a change is material, we will notify you in the app or by email before it takes effect and update the date at the top of this page. Continuing to use ShiftRoot after that means you accept the new terms. If you do not accept them, please stop using the Service and cancel any subscription.

17. Governing law and disputes

These terms are governed by the laws of India. Subject to the paragraph below, the courts at Sirmaur, Himachal Pradesh, India have exclusive jurisdiction over any dispute arising out of or relating to these terms or the Service.

If you are a consumer, nothing here deprives you of the protection of the mandatory consumer laws of the country where you live, and you may also be entitled to bring proceedings there.

If any part of these terms is found unenforceable, that part is severed and the rest continues to apply. Our failure to enforce a right is not a waiver of it.
